La parabola vincente dell’appalto integrato: introdotto, interdetto, riproposto e ora parte del nuovo Codice degli appalti pubblici

Integrated contract is a legal institution that allows you to contract not only the execution of the works but also, at the same time, their executive planning. It is an ‘instrument’ considered capable of accelerating the timing of the construction of public works, despite having in the past given rise to illicit behavior such as to benefit companies rather than the needs of the community. If behavioral responsibilities cannot be attributed to it; what can be done is to evaluate in which areas the integrated contract is suitable for achieving the pre established objectives (certainty of times and quality of the works) and if, without meaning to, it facilitates unethical actions. The text examines the issue of its reintroduction, as foreseen by the New Public Contracts Code (2023), in the specific sector of the restoration of architectural heritage, a return which has raised consensus and doubts.

Con riferimento al documento di Indirizzo per la Qualità dei Progetti di Restauro dell’Architettura proposto dalla SIRA (Società Italiana per il Restauro dell’Architettura) in cui si affronta il tema della qualità del progetto entro il quadro giuridico amministrativo attuale, si vuole qui approfondire il tema dell’appalto integrato nello specifico settore del restauro dei beni architettonici, il cui ritorno nel nuovo Codice dei Contratti Pubblici di cui al D.lgs. 36/2023 ha sollevato consensi e perplessità.
